1. Agreement and eligibility
These Terms of Service (the “Terms”) are a binding agreement between you and MyGreatWay Inc. (“MyGreatWay,” “we,” “us,” or “our”) governing the MyGreatWay website, software, APIs, communications, and related services (the “Services”). By creating an account or using the Services, you agree to these Terms and acknowledge our Privacy Policy.
You must be at least 18 years old and legally able to form a contract. A person accepting for an organization represents that they have authority to bind it. We block registrations that self-report an age under 18.
2. Accounts, workspaces, and security
Provide accurate information, keep credentials confidential, and promptly notify support@mygreatway.com of suspected unauthorized use. You are responsible for activity by authorized users and for configuring tenant roles, marketing permissions, and integrations. Accounts require email verification and may be suspended for fraud, abuse, security risk, nonpayment, or material violation of these Terms.
3. Electronic records and signatures
You consent to receive contracts, notices, invoices, policies, and other account records electronically at the email address you provide. You may withdraw this consent or request a paper copy at no charge by emailing support. Withdrawal applies prospectively and may require us to close features that can only be delivered electronically. You need an internet-connected device, a current browser, and software capable of displaying and saving HTML or PDF. Update your email address so notices reach you. This disclosure is intended to support West Virginia Code § 39A-2-1 and applicable federal electronic-record requirements.
4. Service plans, fees, and cancellation
Plan descriptions, usage limits, renewal periods, taxes, and prices shown at checkout become part of these Terms. Unless an order says otherwise, paid plans renew automatically until canceled before renewal. You authorize charges to the payment method on file. We disclose material price changes before the next renewal. Fees already earned are nonrefundable except where law or the applicable order requires otherwise.
5. MyGreatWay SMS Programs
MyGreatWay offers two distinct, optional messaging choices. You may select either choice, both choices, or neither. Each choice is unchecked by default, recorded separately, and separate from the Terms of Service, Privacy Policy, registration, and any purchase.
5.1 Informational SMS
If you expressly select the informational SMS checkbox, MyGreatWay may send recurring informational texts about your account, requested appointments, service updates, and support conversations you initiate. Informational consent does not authorize marketing or promotional messages.
5.2 Marketing SMS
If you separately provide express written consent by selecting the marketing SMS checkbox, MyGreatWay may send recurring automated marketing and promotional texts, including offers, product news, and sales follow-ups. Informational consent, registration, a purchase, or submitting a general form does not authorize these marketing messages.
- Message frequency varies; recurring messages may be sent.
- Message and data rates may apply.
- Reply STOP to opt out. We may send one confirmation message and will then stop messages from that sender unless you enroll again.
- Reply HELP for help, email support@mygreatway.com, or visit aiapp.mygreatway.com.
- Consent to either SMS category is not a condition of any purchase or registration.
- Wireless carriers are not liable for delayed or undelivered messages.
MyGreatWay does not use purchased, rented, or third-party contact lists for these programs. Do not use MyGreatWay to message recipients without legally sufficient, campaign-specific consent. Each business using our platform is responsible for its own sender registration, campaign content, consent evidence, quiet hours, suppression lists, and compliance. See our Privacy Policy for mobile-data practices.
6. Email and service communications
We may send transactional emails needed to verify and operate your account. Marketing email requires a lawful basis and includes an unsubscribe method. You are responsible for honoring recipients’ choices and applicable marketing laws when using campaign features.
7. Acceptable use
You may not use the Services to violate law; deceive, harass, discriminate, or exploit; send spam or prohibited content; scrape or purchase unlawful contact lists; evade carrier or platform controls; upload malware; probe security; interfere with service; impersonate others; infringe rights; or use AI output without appropriate review. You must maintain consent records and promptly honor STOP, unsubscribe, deletion, and suppression requests.
8. Customer data, AI features, and integrations
You retain rights in content you submit and grant us a limited license to process it to provide, secure, support, and improve the Services as described in the Privacy Policy and any applicable data-processing agreement. You represent that you have the necessary rights and notices. AI output can be inaccurate, incomplete, or unsuitable; review it before use. Third-party services such as communications, payment, analytics, and AI providers have their own terms, and availability may depend on them.
9. Intellectual property and feedback
MyGreatWay and its licensors own the Services, branding, software, and documentation, excluding customer content. We grant a limited, revocable, nonexclusive, nontransferable right to use the Services during the subscription. Feedback may be used without restriction or compensation, without identifying you publicly.
10. Suspension, termination, and export
You may stop using the Services or cancel as provided in your plan. We may suspend or terminate access for material breach, legal obligation, security threat, or service discontinuation. Where feasible, we provide notice and a reasonable opportunity to export customer data. Retention and deletion after termination follow the Privacy Policy, legal holds, backups, and applicable order terms.
11. Warranties and liability
To the maximum extent permitted by law, the Services are provided “as is” and “as available.” We do not guarantee uninterrupted operation, delivery by telecommunications carriers, campaign approval, specific marketing results, or error-free AI output. Nothing excludes warranties, remedies, or liability that cannot lawfully be excluded, including rights under West Virginia consumer-protection law. To the extent permitted by law, neither party is liable for indirect, incidental, special, consequential, or punitive damages, and MyGreatWay’s aggregate liability is limited to fees paid for the affected Services during the twelve months before the event giving rise to the claim.
12. Governing law and disputes
These Terms are governed by the laws of the State of West Virginia, without regard to conflict-of-law rules. Before filing a claim, contact us and allow 30 days for a good-faith attempt to resolve it. Subject to any nonwaivable consumer right or small-claims option, exclusive jurisdiction and venue lie in the state or federal courts located in West Virginia. Nothing in these Terms waives rights or remedies that cannot be waived under West Virginia Code Chapter 46A or other applicable law.
13. Changes, notices, and contact
We may update these Terms. The version and date appear above. We will provide advance notice of material changes when required and request renewed acceptance when appropriate. Continued use after an effective change constitutes acceptance only to the extent allowed by law. Questions, paper-copy requests, legal notices, or accessibility requests may be sent to:
